Identify the 112 Rejection Type

In the Rejection Resolver, 112 rejections are marked with a blue badge. The card distinguishes between 112(a) (written description/enablement) and 112(b) (indefiniteness). Each type requires a different response strategy.

112(a): Written Description Support

For written description rejections, Abigail searches your specification for passages that support the rejected claim language. The AI identifies paragraphs, figures, and examples that demonstrate the inventor was in possession of the claimed invention.

Note

Written description requires showing the specification describes the claimed invention, not just that one skilled in the art could figure it out.

112(a): Enablement Analysis

For enablement rejections, Abigail evaluates the Wands factors: breadth of claims, nature of invention, state of prior art, predictability, amount of direction, working examples, and quantity of experimentation needed. The AI generates arguments addressing each relevant factor.

112(b): Indefiniteness

For indefiniteness rejections, Abigail identifies the specific claim terms the examiner considers indefinite. The AI then searches the specification and prosecution history for definitions, explanations, or contextual usage that clarifies the meaning.

New Matter Detection

When suggesting amendments to overcome 112 rejections, Abigail includes a new matter check. Every proposed addition is traced to a specific passage in the original specification to ensure no new matter is introduced.

Important

Adding claim language without specification support creates a 132 new matter rejection -- Abigail flags these automatically.
