How Does ABIGAIL Monitor Patent Deadlines Automatically?

ABIGAIL runs automated deadline checks via a Cloud Scheduler cron job that queries every active case in your portfolio. When a deadline crosses a threshold — 30, 14, 7, 3, or 1 days remaining — ABIGAIL sends an email alert. Critical deadlines (3 days and under) also trigger SMS if you have a verified phone number on your account.

The monitoring runs without any action required from you. Every case you add to ABIGAIL is automatically included in the nightly check. There is no separate configuration step to enable monitoring — it is on by default for all active cases.

Critical threshold: Deadlines at 3 days or fewer are classified as critical and trigger both email and SMS. Deadlines above 3 days send email only, unless you configure SMS for all thresholds in your notification preferences.

Deduplication built in: The notification system records every alert sent in a log. If a deadline check runs and the threshold was already triggered for that case and threshold, no duplicate alert is sent.

Does ABIGAIL Notify Me When a New Office Action Arrives?

Yes. When ABIGAIL detects a new Office Action for any case in your docket, it sends an immediate notification email with the OA type and the response deadline. This notification fires when the OA is detected, not just on the nightly check cycle.

The Office Action notification includes the application number, Office Action type (non-final rejection, final rejection, restriction, etc.), the mailing date, and the calculated response deadline. The case is automatically moved into the appropriate urgency bucket in the docket.

Can I Configure Which Patent Deadline Alerts I Receive?

Yes. ABIGAIL notification preferences allow separate configuration for four categories of alerts: deadline warning alerts (more than 3 days), critical alerts (3 days and under), Office Action alerts, and portfolio digest emails. Each category has independent email and SMS toggles.

What Is the Portfolio Digest?

The portfolio digest is a scheduled summary email of your docket status, available at daily, weekly, or monthly frequency. It gives you a periodic overview of your entire portfolio without requiring you to log in to check the dashboard.

The digest includes cases grouped by urgency level, upcoming deadlines sorted by days remaining, any new Office Actions detected since the last digest, and cases with recent status changes. It is designed as a brief at-a-glance summary, not a replacement for the full docket dashboard.

What Happens After I Receive an Office Action Alert?

The Office Action alert is the start of ABIGAIL's response workflow, not just a notification. When you open the case after receiving an OA alert, ABIGAIL has already done the following:

Does ABIGAIL track deadlines for extensions of time?

Yes. When ABIGAIL calculates response deadlines, it tracks the statutory deadline (3 months for most non-final rejections). Extensions of time beyond the statutory period can be filed for 1, 2, or 3 additional months. ABIGAIL tracks the extended deadlines as you update the case.

What if a deadline changes after an alert has been sent?

If a deadline is updated — for example, because an extension of time was granted or a response was filed — ABIGAIL updates the case record on the next nightly sync. Future threshold alerts will use the updated deadline. Past alerts already sent are not retracted.

Can I receive alerts for cases I am not the attorney of record?

Yes. Any case added to your ABIGAIL account is monitored regardless of who is the attorney of record at USPTO. This allows monitoring of cases being watched for competitive or portfolio analysis purposes.

Does ABIGAIL monitor PCT applications and national stage deadlines?

PCT applications can be added to the docket. National stage entry deadlines and PCT chapter deadlines are tracked. The specific deadline calculations depend on the PCT filing date and priority date in the USPTO record.
