What an Office Action Response Costs in 2026

You have an Office Action in hand and you want to know what the response will cost before you start. Here is the arithmetic I use: the software line, your own time, and the parts you do not pay for at all.

Three lines, not one

A response has three cost lines and people usually quote only one of them. The software line is what a tool charges you. The time line is your own hours at your own rate. The third line is the Office fee schedule, which depends on how late you file and how many claims you have, and which I keep out of this page on purpose.

Government fees have a home already. Use the deadline calculator for extension timing and the claim counter for claim counts. Those two tools carry the current figures. This page is about what you pay Abigail and what you spend of your own day.

The software line, per task

Abigail bills per finished document, not per month and not per seat. Analysis of the Office Action carries no charge. You pay when you export something you can file.

The time line, at a rate you can defend

The bigger number in most responses is not the software. It is the hours. The only rate I will put on this page is the one the government itself uses: the USPTO adopted the AIPLA 2025 Report of the Economic Survey average of $550 per hour for IP legal work in its own rulemaking (Federal Register, 2026-07-17, doc 2026-14389).

The arithmetic

Total = your hours on this response x your rate, plus $99 for the export, plus whatever the Office charges for the filing posture you choose.

Use your own hours. I am not going to tell you how long your case takes, and any vendor who does is guessing. Time the next three responses you file, then put your own number in.

Why the software line is flat

You know the number before you start

A flat $99 export means the software cost of a response is a line you can quote to a client on the day the OA arrives, not a variable you discover at the end of the month.

A quiet month costs nothing

No subscription, no seat fee, no annual contract. If you file no responses this month, the software line is zero.

Flat fees stay flat

If you work on a fixed fee per response, a fixed software cost per response keeps the margin arithmetic simple. Nothing to allocate across cases.
